These Terms and Conditions ("Terms") govern the relationship between Outdoor Adventure Booking ("Company", "we", "us", "our") and you, the customer ("customer", "you", "your"), for all adventure tours, activities, and services (collectively, the "Tours") booked through our platform. By booking a Tour with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. The Booking Contract
Your booking is confirmed, and a binding contract exists when we issue a written confirmation after receiving the applicable deposit or full payment. Please carefully review your confirmation and immediately report any incorrect or incomplete information. You must be at least 18 years of age to make a booking and agree to provide full, complete, and accurate information for all participants in your party. All participant names must exactly match their respective government-issued identification.
2. Payment and Deposits
We accept payment via Credit Card, Venmo, and Zelle. A non-refundable reservation fee of $50.00 is required to secure your booking, applicable for all Adventures excluding the larger boats, which is the reservation fee plus 50% down payment of total adventure booking. The remaining balance is due at the time of check-in for your adventure (24-hour prior). If we do not receive the full payment by the due date, we reserve the right to treat your booking as cancelled and retain the deposit.
3. Changes and Cancellations
3.1. Cancellations by the Customer
You may cancel your booking by providing written notice to us by sending an email to us with your full name, reservation number, adventure name, time, date, and your contact information.

Refunds and cancellation fees will be determined based on the time before your scheduled activity, as follows:
More than 72 hours (3 days)

No fee, maybe just a small admin charge if you want (e.g. 5%)

We strongly recommend that you purchase comprehensive travel insurance to cover any cancellation fees.
3.2. Changes and Cancellations by the Company
We reserve the right to modify or cancel a Tour at any time for any reason, including but not limited to, safety concerns, inclement weather, or failure to meet minimum participation numbers. If we cancel a Tour, we will offer you the choice of a full refund or a credit towards a future booking. We are not responsible for any incidental expenses you may have incurred because of your booking, such as visas, vaccinations, or non-refundable flights.
4. Assumption of Risk and Liability Waiver
By booking a Tour, you acknowledge and agree that participation in adventure activities carries inherent risks, including but not limited to, personal injury, illness, death, property damage, and other losses. You voluntarily assume all risks associated with your participation in the Tour. You agree to release, waive, and discharge the Company, its officers, employees, agents, and affiliates from all claims, demands, and causes of action of any kind arising from your participation in the Tour, including those arising from our negligence.
5. Participant Responsibilities
You are responsible for ensuring you are in good health and have the necessary fitness level for the Tour you have booked. You must also obtain all required travel documents, including a valid passport (with at least 6 months validity beyond your travel dates), visas, permits, and any necessary vaccination or medical certificates. You agree to comply with all applicable laws and regulations of the countries you visit, as well as our code of conduct.
6. Third-Party Suppliers
We make arrangements with third-party suppliers, such as airlines, hotels, and local guides, to provide some of the services for your Tour. While we take all reasonable care in selecting our suppliers, we cannot control their actions or omissions. Therefore, we are not liable for any injury, damage, loss, accident, delay, or irregularity that may be occasioned by any act or omission of any third-party supplier.
7. Force Majeure
We will not be liable for any failure to perform our obligations under these Terms if such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government actions, extreme weather conditions, natural disasters, or disease outbreaks (including pandemics such as COVID-19). In such circumstances, we may cancel or modify Tours without liability, subject to offering alternative arrangements or refunds where reasonably possible.
8. Code of Conduct
All participants must conduct themselves in a manner that is respectful to other participants, guides, and local communities. We reserve the right to remove any participant whose behavior is deemed inappropriate, dangerous, or disruptive to the Tour experience. No refund will be provided for participants removed due to misconduct
9. Privacy and Data Protection
We are committed to protecting your privacy and will only collect and use your personal information as necessary to provide you with our services and in accordance with our Privacy Policy, which is available on our website. We comply with applicable data protection laws and regulations.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, the State of Georgia, the State of Nevada, the State of Texas, the State of Arizona, the State of California, the State of North Carolina, and the State of South Carolina, USA, without regard to their conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the respective states.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be fully valid and enforceable to the fullest extent permitted by law.
12. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding your booking and supersede all prior agreements, understandings, and communications, whether written or oral.
